Priority Unsecured Claims

The following are the priority unsecured claims most relevant to business liquidations, in descending order of priority (i.e., claims higher on the list get paid first):

  • Claims for administrative expenses of the bankruptcy, including trustee fees, legal and other professional fees.
  • Claims for unpaid wages, salaries, and commissions due workers, if earned within 180 days before the bankruptcy filing, up to a maximum of $10,000 per person.
  • Claims for unpaid contributions to employee benefit plan
