Series 53: Hypothecation Agreement

Taken from our Series 53 Online Guide

Hypothecation Agreement

A hypothecation agreement is one in which a broker-dealer agrees to lend money to a customer, who pledges an amount of his assets as collateral for the loan. This agreement allows the lender to seize the borrower’s securities if the customer defaults.

If a new client wishes to engage in margin trading, the hypothecation agreement must be included with a new client form.
