Recordkeeping Requirements
In addition to submitting reports to the MSRB about political contributions, dealers and advisors must also maintain records of political contributions. These records must include a list of:
- • Names, addresses, and titles of the dealer’s MFPs or the advisor’s MAPs
- • Names, addresses, and titles of the dealer’s non-MFP executive officers or the advisor’s non-MAP executive officers
- • States in which the dealer or advisor seeks to engage in municipal securities business
Records for the current calendar year and each of the two previous years must also include a list of:
- • All the issuers with which the dealer or advisor has dealt in municipal securities business or municipal advisory business
- • All contributions made to officials of an issuer or political party by the dealer or advisor
- • All reported contributions or payments made by an MFP, MAP, non-MFP executive, or non-MAP executive
- • All contributions made to a bond ballot campaign by the dealer or advisor
- • All reported contributions made to a bond ballot campaign by an MFP, MAP, non-MFP executive, or non-MAP executive
Records pertaining to business dealings with issuers and contributions to officials of issuers must identify the name of the contributor, the name and title of the recipient of the contribution, and the amount and date of the reported contribution.
Records pertaining to contributions to a bond ballot campaign must identify the official name of the bond ballot campaign recipient, the jurisdiction for which the municipal securities would be issued, the full issuer name and full issue description of any primary offering resulting from the bond ballot campaign, and payments or reimbursements related to any bond ballot contribution that are received by the dealer from any third party.
